On July 2, 2019, according to the Announcement of the Arrangement of Conformity Assessment System Implementation of Restricted Use Hazardous Substances in Electrical and Electronic Products released by General Administration of Market Regulation and Ministry of Industry and Information Technology (Market Supervision Administration of the Ministry of Industry and Information Technology Announcement No. 23, 2019), in order to ensure the proper implementation of the conformity assessment on the restricted use of hazardous substances in electric and electronic products, the “supplier compliance mark” for self-declarative use in the conformity assessment on the restricted use of hazardous substances in electric and electronic products is clarified as follows:


Administrative Measures on the Restricted Use of Hazardous Substances in Electrical and Electronic Products (Chinese RoHS 2)

 

On January 6, 2016, the Administrative Measures on the Restricted Use of Hazardous Substances in Electrical and Electronic Products was examined and approved on the Ministry of Industry and Information Technology ministerial meeting and agreed upon by National Development and Reform Commission, Ministry of Science and Technology, Ministry of Finance, Environmental Protection Department, Ministry of Commerce, General Administration of Customs, Quality Supervision Bureau, and announced by joint announcement No. 32 of 8 departments including Ministry of Industry and Information Technology of the People's Republic of China, effective as of July 1, 2016.


Electrical and electronic products means equipment which is dependent on electric currents or electromagnetic fields in order to work properly and equipment for generation, transfer and measurement of such currents and fields and designed for use with a voltage rating not exceeding 1000 volts for alternating current and 1500 volts for direct current.  Equipment involved in power generation, transmission and distribution is excluded.  


Hazardous substances refer to the following substances contained in electrical and electronic products:

1. Lead and its compounds;

2. Mercury and its compounds;

3. Cadmium and its compounds;

4. Hexavalent chromium compounds;

5. Polybrominated biphenyls (PBBs);

6. Polybrominated diphenyl ethers (PBDEs);


Arrangement for The Implementation of The Conformity Assessment System for The Restricted Use of Hazardous Substances in Electrical and Electronic Products


On May 16, 2019, General Administration of Market Regulation and Ministry of Industry and Information Technology issued the Announcement of the Arrangement of Conformity Assessment System Implementation of Restricted Use Hazardous Substances in Electrical and Electronic Products, stipulating products manufactured and imported after November 1, 2019 which are included in Restricted Use of Hazardous Substances in Electric and Electronic Products Standard Management Catalogue (First Batch) shall all meet the requirements of the Arrangement, i.e. the supplier should either choose the national voluntary certification or self-declaration for the conformity assessment of the restricted use of hazardous substances in electric and electronic products. For voluntary certification, it is required that the certification body submit the certification result to the public service platform within 5 working days after obtaining certification of relevant products. If the supplier chooses self-declaration, it shall submit the compliance information on the public service platform within 30 days after the product release.


Conformity assessment system


National voluntary certification:

Certification activities uniformly carried out and regulated by the state for electrical and electronic products applied by enterprises on a voluntary basis and certified by a third party certification body as conforming to the standards and technical specifications for the restricted use of hazardous substances.


Supplier Compliance Declaration:

The supplier (including the manufacturer, authorized representative, etc.), in order to verify that the electrical and electronic products provided meet the requirements of the standards and technical specifications of restricted use of hazardous substances, independently adopts a reasonable way to complete the conformity assessment and submit the conformity information of the products. The supplier shall, after completing the product conformity assessment, submit the corresponding product conformity information according to the Supplier Compliance Declaration on Conformity of the Restricted Use of Hazardous Substances in Electrical and Electronic Products. The supplier shall be responsible for the authenticity, completeness and consistency of its self-declaration and relevant technical supporting documents, and shall make a public commitment to accept the supervision of all parties. 


Management Catalogue of Restricted Use of Hazardous Substances in Electrical and Electronic Products (The First Batch)


On March 15, 2018, Ministry of Industry and Information Technology (MIIT) issued the Management Catalogue of Restricted Use of Hazardous Substances in Electrical and Electronic Products (The First Batch) and the Exception Application List of Restricted Substances of the Management Catalogue in Electrical and Electronic Products, which shall be implemented one year after the announcement.


The contents of lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls and polybrominated diphenyl ethers of the products included in the catalogue shall meet the relevant standards such as the requirements for the restricted use of hazardous substances in electrical and electronic products, and shall be included in the management scope of the conformity assessment system for the restricted use of hazardous substances in electrical and electronic products. Those listed in the Exception Application List of Restricted Substances of the Management Catalogue of Conformity to Standards may temporarily not be implemented in accordance with this requirement.
